Welcome to users of the Aurora AOne app ("our app"). Our app, and the services available using it, are provided by us, Aurora Limited, a Company registered under the laws of England, whose registered office is at 6 Little Burrow, Welwyn Garden City, England, AL7 4SW on behalf of itself, its subsidiaries, and where those subsidiaries are holding companies their subsidiaries and so on, and for the benefit of all their respective present and future subsidiaries, each individually and collectively hereinafter referred to as ("Aurora").


We are a limited company registered in England and Wales under company number 03789712. Our VAT number is GB 880 7720 05.


In this policy we describe what information we collect and what uses we put it to.


WHAT INFORMATION WE COLLECT AND HOW WE COLLECT IT


When users register on our app, we ask them to specify their name, email, and a password. If a user is aged 13 or under, they are prohibited from registering on the app. If they are aged 13 – 17 years of age, a parent or guardian must register on their behalf.


We will also hold information associating you with other users who are part of the same group authorised to control a particular lighting fixture. We collect and process data regarding your use of the app, including any descriptions you have given to lighting fixtures or clusters of lighting fixtures, any schedules you create for control of the lighting fixtures.


We collect your location data.


We collect personally identifiable information from our users as part of any contact made by users in relation to any comments, questions or complaints they have.


HOW WE USE THE INFORMATION WE COLLECT


Upon activation of an account, the information submitted will be used by us to allow the registered user to use our app and our lighting fixture management service.


Additionally, we may use the information for the following purposes:


- to help us identify users and any accounts held with us;


- customising the app and the service to a user's particular preferences;


- notifying users of any changes to the app or to our services that may affect them.


In addition, we may anonymise and aggregate data regarding your usage of the app for the purposes of research, statistical analysis and behavioural analysis, and to help improve and optimise the app and our products and services;


MARKETING AND OPTING OUT


If you have given permission, we may contact you by SMS or email about products we think may be of interest to you. If you prefer not to receive any direct marketing communications from us, you can opt out at any time. For more details see 'Your rights', below.


DISCLOSURE OF YOUR PERSONAL DATA


We may disclose your personal data as follows:


- If you are a user of the app, your account activity will be able to be viewed by those with admin rights to the customer account under which you use the app;


- our agents and service providers who assist us in providing the app (including those who help us make the communications to and from the app secure); and


- If our business is sold or integrated with another business your details may be disclosed to our advisers and any prospective purchasers and their advisers and will be passed on to the new owners of the business.


KEEPING YOUR DATA SECURE


We will use technical and organisational measures to safeguard your personal data, for example:


- access to your account is controlled by a password and username that are unique to you; and


- we store your personal data on secure servers of our hosting partners.


While we will use all reasonable efforts to safeguard your personal data, you acknowledge that the use of the internet is not entirely secure and for this reason we cannot guarantee the security or integrity of any personal data that are transferred from you or to you via the internet. It remains your responsibility to:


- Ensure nobody else will use our app while you are logged into your account (we advise our users to take extra care when using public computers/devices and to NOT leave themselves logged in; it is your responsibility to ensure this does not happen);


- Log out and exit your account on the app when you are not using it, on any private and/or public computer or device; and


- Keep your password and any account details or access details secret and to yourself.


TRANSFERS OF DATA OUTSIDE THE EEA


We use ZenDesk to help us provide support and troubleshooting in respect of our app. ZenDesk may have access to the personal data we hold about you and uses servers outside the UK and European Economic Area ("EEA"), including servers in the United States. The data protection and other laws of countries outside the EEA may not be as protective of your information as those in the UK or the EU, but we have taken steps to confirm that your privacy rights are respected and your personal information adequately protected as required by applicable law. INFORMATION ABOUT OTHER INDIVIDUALS


If you give us information on behalf of someone else (for example, someone you wish to be sent a link to download the app) you confirm that the other person has appointed you to act on his/her behalf and has agreed that you can:


- give consent on his/her behalf to the processing of his/her personal data;


- receive on his/her behalf any data protection notices; and


- give consent to the transfer of his/her personal data abroad.


LINKS TO OTHER APPS


Our app contains links to websites, including websites of service providers listed in our app. This privacy policy applies only to our app, so when you visit other websites please read their privacy policies, as we cannot accept any responsibility for breaches or issues you may have in relation to privacy once you leave our app.


THE LEGAL BASIS ON WHICH WE PROCESS YOUR INFORMATION


On some occasions, we may process personal information with consent (for example, when you agree to receive email updates about the app, the service or other Aurora products and services). You have the right to withdraw your consent at any time by contacting us on the email address below.


We may also process personal information when we need to do this to fulfil our service or where we are required to do this by law.


We also process your personal information when it is in our legitimate interests to do this and when we consider these interests are not overridden by your data protection rights. Those legitimate interests include using your information for the purposes of operating and improving our service, which we aim to do in a way that works to your benefit and those of other users.


RETENTION


We will retain your personal data for a period of time consistent with the original purpose of collection. For instance, we may retain your information during the time in which you have a user account to use the app and for a period of one year time afterward. We also may retain your information during the period of time needed for us to pursue our legitimate business interests, conduct audits, comply with our legal obligations, resolve disputes and enforce our agreements. To be clear, we may retain anonymised, aggregated usage data beyond that period, but it will not contain any data in respect of any individual user (or group of users).


YOUR RIGHTS


You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. Data protection legislation gives you the following rights:


- to access information held about you;


- to require rectification or erasure of your information; and


- to object to our use of your data to carry out automated profiling in respect of you.
